Annotatsiya. Ushbu maqola investitsiya shartnomalaridagi barqarolashtirish bandlarining xalqaro arbitraj amaliyotida talqin qilinishi, rivojlangan va rivojlanayotgan davlatlar investitsiya siyosatidagi barqarorlik mexanizmlari, shuningdek milliy tartibga solish tizimidagi tizimli zaifliklarni qiyosiy-huquqiy usulda tahlil etadi. Tadqiqotda 1977-yildan 2023-yilgacha bo‘lgan davrni qamrab oluvchi 15 dan ortiq arbitraj qarorlari, ICSID, UNCTAD va OECD hujjatlari tahlil qilingan. Natijada barqarolashtirish bandlarining zamonaviy huquqiy modeli - besh elementli konsepsiya - taklif etilgan va O‘zbekiston uchun qonunchilik darajasidagi aniq tavsiyalar ishlab chiqilgan.
